1. Preamble

Raw African Safaris provides clients with travel, safari, and related services as an agent on behalf of various principals and/or agents engaged in or associated with the travel industry. These may include, among others, airlines, tour operators, hotels, shipping companies, car hire agencies, and other providers of air, land, sea, or other travel arrangements and services (collectively referred to as “the suppliers”).
Upon request, Raw African Safaris will provide you with the identity and terms and conditions of the suppliers relevant to your booking.

2. Liability

Raw African Safaris acts solely as an agent for airlines, tour operators, service suppliers, and other travel organizations. Upon receipt of a booking (which constitutes your acceptance of these Terms and Conditions), Raw African Safaris will transmit the booking to the relevant supplier and use reasonable efforts to secure your reservations and arrangements promptly.

All tickets, vouchers, and receipts are issued subject to the suppliers’ terms and conditions. Your acceptance and/or use of any such tickets or services constitute your agreement to these conditions.

While Raw African Safaris will take all reasonable measures to secure your bookings and ensure your comfort and safety, participation in any tour, safari, or related service (including transportation) is undertaken entirely at your own risk. You and any party on whose behalf you have booked waive all claims—whether for loss, injury, damage, delay, or inconvenience—against Raw African Safaris, its employees, agents, or affiliates, however such loss may arise, including through negligence.

Suppliers may themselves limit or exclude liability, and it is therefore strongly recommended that all travelers obtain adequate insurance coverage.

3. Bookings, Changes of Arrangements, Routes, and Prices

A “booking” or “reservation” refers to any confirmed travel arrangement for transportation, accommodation, sightseeing, or other related travel services made on your behalf with suppliers, excluding peripheral services as described in Clause 6.

Raw African Safaris will endeavor to confirm bookings in writing. Failure to provide written confirmation, however, does not invalidate the booking or constitute negligence.

If an unscheduled extension of your booking occurs due to factors beyond Raw African Safaris’ control (such as flight delays, weather, or strikes), all resulting expenses (e.g., accommodation) will be your responsibility.

If a supplier is unable to provide the booked service, Raw African Safaris will endeavor to offer suitable alternatives. If you reject such alternatives, any refunds will be subject to the supplier’s own terms.

While every effort is made to adhere to confirmed itineraries, Raw African Safaris reserves the right to make changes where necessary (for example, due to weather or operational considerations). Such changes do not entitle you to a refund.

Deposits and Price Adjustments

• Unless full payment is due at the time of booking, a non-refundable deposit of 30% of the quoted price (or as otherwise specified) is required to secure a booking.
• Flights generally require a 100% deposit, and villa bookings may require a 50% deposit.
• Deposits are non-refundable and form part of the booking conditions. Failure to pay the deposit by the specified due date may result in cancellation of the booking.

The quoted price is based on prevailing rates and costs at the time of quotation. Should there be any increase in supplier costs or exchange rate fluctuations prior to final payment, such increase will be for your account and payable upon request.

4. Payment and Additional Charges

Final payment must be received by Raw African Safaris no later than 60 days prior to departure, unless otherwise agreed in writing. Some suppliers may require earlier payment, particularly during peak travel periods.

Bookings made within 60 days of departure require full payment at the time of booking.

Final invoicing will reflect the confirmed price, less deposits paid, plus any additional charges incurred on your behalf. All payments must be made in full, without deduction or set-off.

Interest at 2% above the prevailing prime bank rate may be charged on overdue accounts.

Raw African Safaris reserves the right to charge additional administrative, consultation, amendment, and communication fees where applicable.

5. Insurance

Raw African Safaris strongly recommends that you and all members of your party obtain comprehensive travel insurance at the time of paying your deposit. Such insurance should cover cancellation, curtailment, medical expenses, emergency evacuation, personal accident, baggage, and loss of money.

You acknowledge that it is your responsibility to secure adequate insurance, and Raw African Safaris accepts no liability for any loss or damage resulting from your failure to do so.

6. Peripheral Requirements

Raw African Safaris may assist clients in obtaining passports, visas, health certificates, and other travel documentation; however, this service is offered as a courtesy and without liability. Because such requirements may change without notice, Raw African Safaris cannot guarantee accuracy, timeliness, or completeness of this information.

7. Cancellation

If you cancel your booking, Raw African Safaris reserves the right to charge cancellation fees, including all supplier charges and administrative costs.

Cancellations must be submitted in writing. Refunds, if applicable, will be processed as follows:

• 60 days or more before departure – 70% refund
• 31–59 days before departure – 50% refund
• 30 days or less before departure – No refund

Airline ticket cancellations are subject to the relevant airline’s fare rules and refund timelines (which may take up to 8 weeks).

Raw African Safaris also reserves the right to cancel any booking where payment is overdue, in which case all amounts paid may be forfeited.

No refunds are given for no-shows, late arrivals, early departures, or unused services unless agreed in writing.

8. Interpretation, Applicable Law, and Jurisdiction

This Agreement shall be governed by the laws of the Republic of South Africa.

Both parties consent to the non-exclusive jurisdiction of the South African courts and, where applicable, the appropriate Magistrate’s Court.

No indulgence or extension of time granted by Raw African Safaris shall affect its rights or constitute a waiver thereof.

This document represents the entire agreement between you and Raw African Safaris, superseding all prior communications or representations. Any amendments must be in writing and signed by both parties.

9. Flight Information

• Passenger names must match passport names exactly.
• Once issued, air tickets are subject to the airline’s fare rules regarding changes and cancellations.
• Airfares are only guaranteed once payment has been received in full and tickets issued.
• Any increase in airport taxes or fuel surcharges prior to travel will be for your account.
• Raw African Safaris cannot guarantee specific seats, meals, or baggage handling.
• All baggage remains your responsibility, and the company accepts no liability for loss or damage.

10. General

• No variation or amendment of this Agreement will be valid unless in writing and signed.
• If any clause is declared invalid, the remaining clauses will remain enforceable.
• Failure by either party to enforce any right will not constitute a waiver of that right.
• Raw African Safaris shall not be held liable for any failure to perform due to circumstances beyond its control, including but not limited to natural disasters, strikes, or government actions.
• Updated versions of these Terms may be issued from time to time. Please ensure you review the latest version before confirming a booking.

12. Confidentiality and Communication

Raw African Safaris is committed to protecting your personal information. By engaging with the company, you consent to the collection and electronic storage of personal and non-personal data necessary to process your booking and provide services.

Information collected may include names, contact details, travel preferences, and relevant documentation. This data will not be disclosed to third parties except as required to fulfill your booking or by law.

13. Complaints and Dispute Resolution

Complaints should be reported immediately to Raw African Safaris at the time of occurrence and followed up in writing within 30 days of the incident, addressed to:

14. Consent to Risk Assumed

You acknowledge that participation in wildlife safaris, outdoor excursions, and travel within Africa involves inherent risks. You voluntarily accept these risks and agree to participate entirely at your own risk, releasing Raw African Safaris from any liability arising from such participation.

15. Raw African Safaris Acting as Agent Only

Raw African Safaris acts solely as an intermediary between you and the suppliers providing services such as transport, accommodation, or excursions. The company is not liable for any acts, omissions, loss, damage, injury, or delay caused by any supplier or third party.
